1. Terms & Conditions

1.1 Acceptance of Terms

By accessing or using the Swimtopia website, you agree to these Terms & Conditions and all applicable laws. You warrant that you are of legal age to form a binding contract and will use the site only for lawful purposes. Swimtopia may modify these terms at any time by posting updates on the site. Your continued use of the site after changes are posted constitutes acceptance of those changes.

1.2 Use of Website Content and Tools

All content on this site, including text, images, calculators, guides and other tools (e.g. water testing, recovery tool, spare part finder, volume calculator, tutorials), is provided “as is” and for general informational purposes only. Swimtopia makes no representations or warranties of any kind, express or implied, about the accuracy, completeness, or suitability of any content or tool. You acknowledge that any reliance on the results of these tools is at your own risk. Swimtopia expressly disclaims all liability for any errors, omissions or outcomes resulting from the use or misuse of site content or tools. Users must exercise independent judgment and verify information before acting on it.

1.3 External Links and Referrals

Swimtopia may provide links or tools that direct users to third-party websites and resources for convenience (for example, a Company Search tool that redirects to the SPASA directory). These links are provided only as a convenience. Swimtopia does not endorse, guarantee, or control any third-party content, products or services found through these links. You access third-party sites at your own risk. Swimtopia accepts no liability for any dealings with companies or organisations obtained via linked external resources.

1.4 Products and Safety

Swimtopia sells products that may include hazardous chemicals. It is the purchaser’s responsibility to comply with all applicable local laws and safety regulations when purchasing, transporting, storing or using these products. All pool chemicals are supplied with appropriate labelling, Safety Data Sheets (SDS) and handling instructions. As Safe Work Australia notes, hazardous chemicals must be kept in a sound, compatible container and safely handled to minimise risk. You must follow all manufacturer instructions and safety guidelines. Disclaimer: Swimtopia makes no warranty regarding the safe use of chemicals and shall not be liable for any damage or injury caused by misuse or improper handling of products.

Under Australian consumer law, all products sold by Swimtopia must be of acceptable quality and fit for purpose. Swimtopia complies with mandatory product safety standards and bans. If a product is defective or unsafe (not caused by misuse), Swimtopia will replace or refund it in accordance with statutory guarantees. However, for any change-of-mind or incorrect-order returns (see section 4), fees may apply.

1.5 Limitation of Liability

Except as required by law, Swimtopia and its affiliates, officers, agents and service providers will not be liable for any indirect, incidental, special or consequential damages arising out of your use of the site or products, even if advised of the possibility of such damages. Swimtopia’s total liability for any claim related to the site or products is limited to the purchase price of the products ordered. Nothing in these Terms & Conditions limits or excludes liability for death or personal injury caused by Swimtopia’s negligence.

1.7 Price Match Guarantee

Swimtopia is committed to offering competitive prices. If you find an identical, in-stock product sold by an authorised Australian retailer at a lower advertised price, we will match that price subject to the conditions below.

• The item must be the same brand, model, specification and condition (new, factory-sealed, covered by the full manufacturer’s warranty).
• The competing price must be publicly available or supported by a written quotation or screenshot dated within the last 7 days, and must include all mandatory costs to you (e.g. shipping, handling, surcharges).
• Both Swimtopia and the competitor must have the item in stock at the time of the request.
• Excludes clearance, liquidation, auction, marketplace, second-hand, bundled, coupon-based or membership-only pricing, and any offer that would breach supplier MAP agreements or Australian consumer law.
• Requests must be submitted before purchase or within 48 hours after placing your order by emailing support@swimtopia.com.au with proof of the lower price.
• Once verified, we will adjust your order total before dispatch or refund the difference to your original payment method (or as store credit) within 5 business days of shipment.
• Swimtopia reserves the right to decline a price-match request where any of the above conditions are not met.

2. Privacy Policy

2.1 Overview

Swimtopia is committed to protecting your privacy and handling your personal information responsibly. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what information we collect, how we use and disclose it, and your rights.

2.2 Information Collection and Use

When you visit the Swimtopia site, we automatically collect certain technical information (such as IP address, browser type, pages visited) to help improve our services. We also collect the personal information you provide when you place an order, create an account or contact us (for example, your name, email, postal address, payment details). We use your personal information to process transactions, communicate order status, provide customer service, and send occasional promotional emails (you may opt out of marketing communications at any time).

All personal data is stored securely and used only for the purposes disclosed. We will never sell your personal information to third parties. Swimtopia may engage trusted third-party service providers (e.g. payment processors, shipping companies) to facilitate transactions and delivery; these parties are contractually bound to keep your information confidential and use it only for their specific tasks.

2.3 Cookies and Tracking Technologies

Swimtopia may use cookies or similar tracking technologies to collect usage information and improve your experience. Under the Privacy Act, data gathered by cookies that can identify you is considered personal information. If we implement cookies or other tracking, we will notify you via our site (e.g. a cookie banner) and obtain any necessary consent. You may disable cookies in your browser settings, but doing so may affect site functionality.

Swimtopia does not disclose your personal information to any third parties for their marketing purposes. We will only share data with third parties as necessary to fulfil your order, to comply with law enforcement, or with your consent.

2.5 Data Security and Retention

We use reasonable technical and organisational measures to protect your personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Personal information is retained only as long as needed to fulfil its purpose or as required by law.

3. Shipping Policy

3.1 Shipping Methods and Carriers

Swimtopia ships products nationwide using reputable couriers (such as Australia Post, DHL and StarTrack). We offer two main shipping options within Australia:

• Standard Shipping: Free for orders of AUD $79 or more (excludes bulky items). For orders under $79, a flat shipping fee applies (e.g. $9.95).
• Express Shipping: A flat fee of $9.90 per order (Australia only, excluding bulky items). Express orders are prioritised and dispatched immediately during business hours.

3.2 Delivery Times

Delivery times vary by region and shipping method. The following are estimates from shipment date:

• Standard Shipping:
  • NSW, QLD, VIC: 3–6 business days
  • WA, SA, TAS, NT: 6–11 business days
• Express Shipping:
  • NSW, QLD, VIC: 1–3 business days
  • WA, SA, TAS, NT: 2–4 business days

Actual delivery times may vary due to factors beyond our control (e.g. weather, public holidays, or customs delays). We will email tracking info once your order is dispatched. Swimtopia is not liable for shipping delays caused by third-party carriers.

3.3 International Shipping

NOT CURRENTLY AVAILABLE. Swimtopia ships internationally at standard shipping rates (customers are responsible for any import duties, taxes or customs fees levied by their country). Please check local regulations for importing pool chemicals or heavy items before ordering.

3.4 Fulfilment and Tracking

All orders are processed and handed to our third-party logistics partner for fulfilment. Orders usually leave our warehouse within 1–3 business days. Once shipped, you will receive an email with tracking details. Ensure your shipping address is accurate; Swimtopia is not responsible for items delivered to incorrect addresses provided by customers.

4. Returns Policy

4.1 Return Eligibility

Swimtopia will accept returns of most products within 30 days of purchase, provided the items are unused, undamaged and in their original packaging. To initiate a return, contact Swimtopia via email. Returns must be accompanied by proof of purchase. Custom or made-to-order items are non-returnable unless faulty.

If you received a defective or incorrect product, please contact us immediately. Faulty or wrongly supplied items will be remedied under your consumer rights at no cost to you.

4.2 Change-of-Mind Returns

If you simply change your mind or ordered the wrong product, Swimtopia may accept the return subject to these conditions: the item is unused and resalable, returned within 30 days, and in its original packaging. Fees: a 10 % restocking fee and a $15 return shipping label fee will be deducted from your refund. Original shipping fees are non-refundable. Items returned without tracking are at the sender’s risk.

4.3 Non-returnable Items

Certain bulky or perishable items cannot be returned for change of mind. These include, but are not limited to, pool covers and rollers, pool heaters, and other oversized filtration or equipment components. These items are final sale unless defective.

4.4 Return Process

Email support@swimtopia.com.au with your order number and reason for return. We will provide a Return Authorisation and instructions (including a prepaid label for change-of-mind returns). Pack the item securely, attach the label, and ship via the specified carrier. We recommend a trackable service. Refunds or exchanges are processed within 5 business days of inspection.

4.5 Restocking Fee & Refunds

Change-of-mind returns incur a 10 % restocking fee plus a $15 return label fee. Refunds are issued to the original payment method (minus fees) or as store credit. If a return is due to Swimtopia’s error, no restocking or label fees apply and we will refund your full purchase price and shipping fee.

All returns are subject to inspection. If the returned item does not meet our conditions (e.g. damaged or used), we may refuse the return or apply additional charges. In such cases the item will be returned to you at your expense.
